Permits and Inspections

Building Permits in Sunset

Sunset issues its own building permits through its Administration office. The same office is responsible for utilities and business licensing. Applications are filed online through City Inspect or in person at the City Offices.

Sunset

Sunset Administration Office

Each required inspection is scheduled by phone 24 hours in advance. We place those calls as the work reaches each stage. The city's Departments and Services page also lists this office's number for the Planning Commission. Sunset's Building Permits page says that the plans for each project go to the Building Official, and possibly the Fire Chief, for review, and that the permit is issued after those reviews.

ADU Rules in Sunset

Section 10-12-1 of the Sunset City Code, adopted by Ordinance 2025-05 and amended by Ordinance 2026-06 on October 20, 2026, sets these general standards for every ADU, in its own order.

  • An ADU permit for every unit, with city staff processing only applications they deem complete, and every ADU fully permitted and licensed before it is occupied
  • One ADU per property
  • Compliance with the building, health, and fire codes, and an initial building inspection before the ADU permit is approved or issued
  • The International Fire Code for every ADU, with an attached or detached unit held to the home's fire regulations, including the fire code's requirements for fire hydrants and fire apparatus access
  • Fee simple title to the property held by the applicant
  • A separate ADU entrance, not on the same face as the home's entrance, though a detached ADU's entrance may be visible from the street
  • The home's address number, with the ADU designated Unit B and the address posted where it is visible on the street side of the home
  • At least one bedroom, a three-quarter bath, and a kitchen
  • At least one added off-street parking space; never fewer spaces than the vehicles kept on the property; tandem parking in a driveway allowed; every parking area and driveway paved with concrete, asphalt, masonry, or concrete pavers; and no ADU on a lot that cannot meet the parking requirements
  • Garage or carport parking replaced when an ADU is created in that space, and, outside an approved driveway, no parking space in a front yard or side yard setback next to a street and no vehicle parked on the front lawn or other landscaped areas
  • A property kept to current property maintenance and public health codes, and no notice or fine from the city for a code violation on this or any other property in the previous 12 months
  • An owner occupant living on the property, in the home or the ADU, whether a person on the recorded deed, a relative of one as the section defines, or the trustor of a family trust that holds legal ownership of the property
  • Occupants limited to one person living alone, or two related or unrelated adults and their children, plus a temporary guest staying less than 90 days in a rolling year
  • A yearly rental license from the city for every ADU, and rentals of 30 consecutive days or longer only
  • Internal and attached ADUs allowed to connect to the home's water and sewer lines, and a detached ADU with its own culinary water and sewer laterals connected to the main lines, its other utilities, and individual meters before it is occupied, with easements for those utilities, acceptable to the city, provided no later than the recording of the subdivision
  • An existing detached accessory structure converted to a detached ADU only when it meets every detached ADU requirement in the chapter, through the same application and approval process as a new unit

Subsection E retains these standards for an internal ADU, which the section defines as a unit within the home, within its footprint when the unit is created, and for a long-term rental of 30 consecutive days or longer.

  • Internal ADUs in single-family homes in the R-1, R-3, and RT zones only, never on a multi-family lot or on one that does not meet the requirements, such as parking and setbacks
  • Rental use only, with the unit never sold separately
  • Its own living areas for eating and sleeping, including a kitchen, and its own full bathroom with a sink, toilet, and shower or bath, all separate from the main home
  • The owner occupying the unit or the home as a primary residence
  • No separate utility connections
  • No home occupation business in the unit without the owner's express written permission and the approval of the City Business License Official

Ordinance 2026-06 struck the 2025 text barring detached ADUs in every zone. Subsection F now sets these standards for attached and detached units, which Subsection B defines.

  • An attached ADU, built as an addition joined to the home by one or more common walls, that keeps the outward appearance of a single-family residence
  • An attached ADU no larger than 50 percent of the habitable square footage of the home's building footprint, under the same height limit as the home
  • A detached ADU, in an accessory building on the property, no larger than the single-family dwelling on the lot and no taller than the zone allows
  • A minimum lot size of 6,000 square feet for an attached or detached ADU
  • Side and rear setbacks the same as the home's for an attached or detached ADU, in the table rows the city titles Maximum Side Setback and Maximum Rear Setback

For every type, the application includes detailed floor plans. Certificates of inspection are submitted before the permit is issued. Utah's ADU statutes apply in Sunset as well, as our ADU page explains.

Subsection C allows each type of ADU only in the residential zones designated for it. We confirm with the city in which zones your type of unit is permitted, and how these rules apply to your lot, during preconstruction.

What Homeowners Ask

Sunset Remodeling and Permit Questions

Can a detached garage or shed become an ADU in Sunset?

Yes, where the lot's zone allows a detached ADU. Since Ordinance 2026-06, an existing detached accessory structure can be converted to a detached ADU when it complies with every detached ADU requirement in Section 10-12-1, including its own culinary water and sewer laterals to the main lines, its other utilities, and individual meters before anyone occupies it.

Can I apply for a Sunset building permit in person?

Yes. For a residential project, the applicant brings two sets of building plans and a site plan to the City Offices, or the building plans alone for a remodel, and fills out the permit form there. Online, the application goes through City Inspect with the completed form and the plans.

Who maintains the sewer lateral serving a Sunset home?

The owner. Sunset's Construction and Development Standards, adopted by the City Council in January 2019, treat the sanitary sewer lateral as private from the main line connection to the point of use. Maintaining and repairing it, including repair of all surface improvements, is the owner's responsibility. A residential lateral is at least 4 inches in diameter and connects along the main line, not into a manhole.
