Permits and Inspections
Building Permits in Newton
The Town of Newton issues its own building permits and takes every application on City Inspect. It contracts plan review and inspections through Hyde Park.
Newton
Newton Town Hall
Under Section 11-4-4 of the town's Land Use Ordinance, a permitted use takes effect only once the Planning Commission has issued a zoning clearance and the building inspector or town clerk has granted any building permit or business license it requires. The town's permit procedure lists the Hyde Park City Offices, at 113 East Center in Hyde Park, for plan review and inspections. An inspection is scheduled by calling extension 25 there or requested on City Inspect.

The town's procedure lists these items a building permit application may require, in its own order.
- Building plans drawn to scale, with exterior elevations, floor plans, a foundation plan, framing detail, a cross-section, stair detail, an electrical plan, and a plumbing and heating plan
- A model energy code analysis for new home construction
- A site plan showing the building, the property lines, and the setbacks
- Proof of ownership or a county plat map
- A notarized owner-builder form, where one applies
For new home construction, the procedure adds a septic tank permit from the Bear River Health Department and proof of a Newton secondary water share, shown by a copy of its certificate. Under Section 11-4-5 of the Land Use Ordinance, the land use authority also confirms that a permitted use meets all requirements of the Bear River Health Department and of any state departments that apply.

Accessory Dwelling Units
ADU Rules in Newton
The Town of Newton treats an ADU as an accessory apartment: a subordinate unit within a single-family detached home or its detached garage, allowed as a conditional use in the A-1, R-1, and C-1 zones. Section 11-7-2(D) of its Land Use Ordinance sets these requirements, in its own order.
- No accessory apartment constructed on a lot ahead of the single-family dwelling
- An apartment attached to or within an existing single-family dwelling, or the garage associated with that dwelling
- An apartment subordinate in size to the single-family dwelling
- An appropriately sized septic system shared by the accessory apartment and the single-family dwelling
- In the commercial zone, an accessory apartment attached to or within an existing, approved commercial business
Under Section 11-4-7, no building permit or other permit or license is issued for a conditional use until a conditional use permit has been approved.
The Newton Town Planning Commission's agenda for October 15, 2026, included a review of an internal accessory dwelling unit code.

Newton Remodeling and Permit Questions
What lot standards apply to a new home in Newton?
Table 11-7-1 of the Land Use Ordinance sets minimums of 1 acre for a lot in the A-1 zone and 0.5 acre in R-1; 148 feet of frontage; and primary building setbacks of 20 feet in front, 15 feet on each side, and 10 feet in the rear. Lot coverage is capped at 50 percent in both zones. Section 11-8-3 permits only one main building on a lot unless the ordinance provides otherwise.
Does a retaining wall in Newton need a conditional use permit?
It does once it stands higher than 36 inches, under Section 11-8-5(B) of the town's Land Use Ordinance. Under Section 11-8-5(A), no fence, wall, or other similar structure in a required front, rear, or side yard may exceed 6 feet, except for the accessory buildings and structures the ordinance permits and except as a conditional use permit allows. Table 11-6-3 lists fences taller than 6 feet as a conditional use in the A-1 and C-1 zones and, in R-1, as not allowed unless another regulation of the zoning ordinance expressly permits them.
How soon does plan review start in Newton?
Newton's permit procedure puts each submitted application in a first-come, first-reviewed queue and states that review of all permits should start within 10 working days. The applicant is notified of any missing items. A member of the Newton Town Planning Commission reviews the site plan submitted with the application.
