Permits and Inspections

Building Permits in Mendon

Cache County does not issue building permits in Mendon. The city's Land Use Authority is responsible for all land use inquiries and permits, including those for new builds and remodels. A zoning clearance must be approved before the building permit application goes in.

Mendon

Mendon City Land Use Authority

Under Section 1.12 of the Zoning Code, the City Building Inspector issues the written permit that the construction or alteration of a structure requires. The section exempts structures under 200 square feet in gross area that have no utilities and stand under 16 feet tall, along with decorative updates that do not affect plumbing, electrical, or structure; are not hazardous; and are not hidden from the view of future owners. The Building Permit Submission Guidelines on Mendon's permit page, updated October 20, 2026, call for every application material in one email, with the project name in the subject line, each file a compressed PDF, and any scanned document at 300 dpi. The city's building permit form requires 24 hours' notice for all inspections.

Building and Zoning Permit Application

Under those guidelines, incomplete applications are not accepted. The guidelines require these materials, in the document's order.

  • A building permit application filled out completely, with the tax or parcel number and the contractor license numbers, then signed and dated
  • An approved Mendon City Zoning Clearance
  • A Manual J and D form from the mechanical contractor for HVAC duct sizing and layout, required only for a new single-family dwelling with a furnace and for a remodel that replaces a furnace
  • A complete set of building plans, starting with dimensioned floor plans of all levels, garages, decks, and porches, along with the plumbing, electrical, and heating or air conditioning plans
  • The square footage of every area, including the garage, main floor, upper levels, basement, decks, and porches
  • Elevations of all four sides showing every door and window, the roof with its pitch and covering, and the exterior wall coverings
  • Details of the footings, foundation, walls, trusses or rafters and roof section, and joists; of all egress items, such as bedroom windows, doors, and stairways; and of the fireplace, beams, cantilevers, and all cross-sections
  • An engineering packet or an engineer's stamp if needed, with engineered plans required for every new single-family dwelling
  • A REScheck verifying that the building meets the energy codes

The guidelines also ask for every plan page compiled into one PDF, indexed or bookmarked with each sheet's number and title; plans fully dimensioned down to the framing plans; and a 3-by-3-inch space for the approval stamp in the same place in every sheet's title block. The Zoning Clearance Application that comes first asks for a site plan drawn to scale, the same one submitted with the construction drawings, along with floor plans of all levels, elevations, a final lot grading plan, culinary water verification, and Bear River Health Department approval. The application notes that review of a completed application may take several weeks. Mendon's General Plan notes that the city has no sewer system and relies on individual septic systems. Resolution 2026-01, which the City Council passed on February 12, 2026, adopts the 2006 Utah Wildland Urban Interface Code, or its successor, along with a Mendon City Wildland-Urban Interface Map kept on file in the City Recorder's office.

Accessory Dwelling Units

ADU Rules in Mendon

Section 3.30 of the Mendon City Zoning Code, last amended by Resolution 2025-12 on November 13, 2025, allows an ADU as an accessory use to a single-family home under these conditions, in its own order.

  • One ADU per lot, located in the principal dwelling or in a garage attached to it
  • Any structure containing an ADU held to the minimum yard and setback requirements for principal structures, set on a foundation, and required to meet all relevant sections of the current building code as Utah law writes them for ADUs, with every other applicable zoning requirement met
  • One off-street parking space for the ADU in addition to the primary dwelling's spaces
  • No ADU placed or created on a lot with an undersized or failing septic system
  • A building permit from the City Building Inspector for constructing a new ADU or creating one within an existing structure, work that may require an updated septic system
  • At least a fully functioning kitchen, bathroom, and bedroom in the unit
  • No ADU in a manufactured or mobile home or the like
  • The owner living in the primary dwelling or the ADU in order to rent the other, unless only the primary dwelling is rented and the ADU is vacant, with occupancy proven by voter registration or by evidence the City Council accepts, such as car registration or utility bills
  • A Level One home occupation or home business allowed, subject to city and state regulations
  • All applicable building, health, and fire codes, as Utah law permits for ADUs

Section 3.40 requires a Mendon City Business License/Rental Permit to operate a long-term rental, which it defines as a residential unit, or any part of one, offered for occupancy for more than 30 consecutive days. Landlords renting to immediate family or relatives are not subject to it. Among the items on the Accessory Dwelling Units and Long-Term Rentals Application printed in Section 3.30 are a building inspection by the Mendon City Building Inspector and a fire inspection by the Mendon City Fire Chief, each scheduled by the owner. Any changes the inspectors require are made before the license is issued. When an ADU is rented, all owners of record also sign the Accessory Dwelling Unit Owner's Affidavit, agreeing to occupy the property as a primary residence and to have no more than one family live in the unit. The owners also agree to offer it only as a long-term rental of 30 consecutive days or longer unless it is licensed for short-term rentals. They certify that the second unit is an accessory dwelling, acknowledge that a future purchaser must relicense it to continue the use, and agree to maintain it in compliance with all applicable building, health, and fire codes.

The R-1 zone names an accessory dwelling among its permitted uses in Section 11.10(B) and again as a conditional use in Section 11.10(C). Section 9.08's parking table lists 1 1/2 off-street spaces per accessory dwelling, attached or detached, with any fractional space rounded up to the next whole number.

Because Section 3.30(A) places an ADU only in the principal dwelling or an attached garage, and Section 11.10(K) bars an accessory structure in the R-1 zone from use as an additional dwelling except under the accessory dwelling provisions of Chapter 3, Mendon allows no detached ADU.

Utah's ADU statutes apply in Mendon as well, as our ADU page explains.

What Homeowners Ask

Mendon Remodeling and Permit Questions

Can I build a detached ADU in Mendon?

No. Mendon's Section 3.30 places an ADU only inside the principal dwelling or in a garage attached to it. Utah's detached ADU statute does not reach a fifth class city of Mendon's size. A unit inside a home its owner occupies, such as a basement apartment, is allowed under the conditions listed in the ADU section above.

What does Mendon require before building on a hillside?

Section 11.22 of the Zoning Code applies to any construction, grading, filling, clearing, or excavation on a hillside with a slope of 15 percent or more, other than trail development no wider than 5 feet with at most 3 feet of cut or fill. Before that work begins, a lot grading plan goes to the City Engineer for review and approval. The section's requirements call for that plan to be prepared and stamped by a professional engineer registered in Utah. Its first general requirement says the plan must be prepared by a civil engineer or land surveyor certified in Utah. We confirm with the city which one it accepts. Any retaining wall over 4 feet tall needs certification by a professional engineer in Utah. The section also states that the city limits construction on lots at or over a 15 percent grade based on the engineer's recommendations, and that, per county restrictions, lots at or over a 20 percent grade may not be built on.

What hours can construction run in Mendon?

Section 18.06(D) of the Zoning Code limits construction to the hours of 7 AM to 7 PM. The limit covers all outdoor excavation, earthwork, and landscaping and any rock breaking, chipping, drilling, or blasting. The section excepts construction that can be totally contained within an enclosed structure and comply with all of the city's noise limits and lighting regulations. Section 18.08 lists exemptions from the noise chapter, among them emergency events, temporary or short-term use of construction equipment during daytime hours, and other temporary exceptions granted with the city's approval.
