ADU Rules in Layton

Layton's ADU handout, updated October 2026, lists conditions that include these, in its own order.

  • A permit for every ADU, applied for online and reviewed within 14 business days, holidays excluded
  • A signed letter of agreement, recorded by the city with the Davis County Recorder's Office, that the owner will use the property as a primary residence and not rent both the home and the ADU
  • A building permit and every other requirement of the building codes and ordinances in force at the time of construction or remodeling
  • No more than one ADU per single-family lot or parcel
  • Every utility connection, such as water, gas, and sewer, from the same lines that serve the home
  • The home's address number for the ADU, visible from the street
  • Rentals of 30 consecutive days or longer to the same occupant, and no short-term rental
  • No mobile home, recreational vehicle, or shipping container as an ADU
  • Occupancy by no more than three unrelated individuals; by one individual; or by one family related by blood, marriage, legal guardianship, fostership, or adoption
  • One parking stall in addition to the two covered stalls the home requires, with no parking space in the home's front or side yard setbacks next to a street unless it sits on an approved driveway
  • An internal or attached ADU within the home's footprint or built as an addition, meeting the home's minimum setbacks and height limits
  • Interior access between the home and an internal or attached ADU maintained, unless the Fire Department approves and inspects sufficient means of egress
  • A detached ADU on a lot or parcel of 6,000 square feet or larger, within the heights and setbacks of Table 6-4, no taller than the home, and no larger than half the home, up to 1,200 square feet
  • A detached ADU in the side yard area no taller than 16 feet to the roof peak for one story or 25 feet for two, with side setbacks matching the home's for one story and 10 feet for two, and rear setbacks matching the home's for one or two stories
  • A detached ADU in the rear yard area no taller than 16 feet to the roof peak for one story or 25 feet for two, with side setbacks of 5 feet for one story and 10 feet for two, and rear setbacks of 10 feet for one story and 20 feet for two

On September 17, 2026, the City Council adopted Ordinance 26-27 as presented, amending Section 19.06.300 of the Layton City Municipal Code. As amended, the section allows an ADU as an accessory use to a legally conforming detached single-family dwelling in a primarily residential zone, but not to an attached single-family home, even in such a zone. It requires every ADU, whether internal, attached, or detached, to be designed consistent with the design of the home. The section caps an attached ADU at 50 percent of the home's livable space, up to 1,200 square feet, leaving garages and non-habitable storage areas out of the count. For internal and attached ADUs, the handout still lists appearance and entrance rules that the ordinance struck from the section. The handout's line that ADUs are permitted in all single-family residential zones also keeps the wording the amendment replaced. During preconstruction, we confirm with the city which text governs your ADU. Utah's ADU statutes apply in Layton as well, as our ADU page explains.
