ADU Rules in Cedar Hills

Section 10-5-32 of the Cedar Hills City Code, amended by Ordinance 07-07-2026C on July 7, 2026, sets conditions that include these.

  • ADUs permitted in every residential zone in the city unless City Code or a development agreement prohibits them
  • No homeowners association ban on ADUs in residential zones where they are otherwise allowed
  • One ADU per lot or parcel, internal or detached
  • A registration with a site plan showing the property lines and dimensions, existing buildings and their entrances, proposed additions, and tenant parking, and an affidavit that the home is owner occupied, without which the unit is not considered legal or approved
  • A registration valid for the year it is first issued and renewed automatically each year after, on evidence that the owner occupies the home and on the city's determination that every condition of approval remains in effect
  • A building permit before any new construction of an ADU begins, and a certificate of occupancy or certificate of completion before anyone occupies it
  • An outside appearance unchanged from that of a single-family home, and no ADU in a multi-family dwelling or on a lot or parcel that cannot meet the parking requirements
  • A dedicated entrance allowed on any side or the rear of the home, or at the front when it is below grade and keeps the home's single-family character
  • The main home addressed as unit A and the ADU as unit B, under the same address number
  • Interior access maintained when the ADU is inside the main dwelling
  • The owner living in the primary dwelling or the ADU, with documentation provided when a trust owns the property
  • An exception to owner occupancy while a family member lives at the home, after at least a year of residence and a temporary absence application filed before leaving, for three years or less on an activity such as a temporary work assignment, sabbatical, or voluntary service, or for a stay in a hospital, nursing home, assisted living facility, or similar facility
  • Rental to one family unit only
  • No more than one meter for each water, gas, and electric service, in the owner's name; no ADU where the home is served by a failing septic tank; and no detached unit that lacks adequate access to sanitary sewer, culinary water, electrical, or stormwater service or that connects to a system improvement lacking capacity
  • One off-street tenant parking space for an internal ADU beyond those the home requires, and two for a detached ADU of 650 square feet or larger or one for a smaller one, with tandem parking in a driveway allowed and no parking in a front or side yard outside an approved driveway
  • A registration that becomes void when the home is sold unless the buyer obtains a new permit, and an ADU that is never sold separately or detached by deed

Utah's ADU statutes apply in Cedar Hills as well, as our ADU page explains.

Ordinance 07-07-2026C struck the section's earlier two-space minimum for every detached ADU. Section 10-5-32 sets no lot size, unit size, height, or setbacks for such a unit. We confirm the parking and the zone's accessory building rules for your property with the city during preconstruction.

What Homeowners Ask

Cedar Hills Remodeling and Permit Questions

Can my HOA stop an ADU in Cedar Hills?

Not where the city's residential zoning allows one, because Section 10-5-32 bars homeowners associations in Cedar Hills from prohibiting ADUs there. An exterior change such as a walkout still needs HOA approval wherever an HOA applies.

Can I act as my own contractor on a Cedar Hills rental property?

No. The city's permit portal requires a general contractor when the property is not the owner's primary residence.

How long does a Cedar Hills building permit stay valid?

The city's permit application states that a permit becomes null and void if the authorized work does not begin within 180 days, or if work is suspended or abandoned for 180 days at any time after it starts. We schedule each phase with that 180-day limit in view.
