ADU Rules in Heber City

The Community Development Director may grant an ADU permit under Section 18.68.611 of the Heber City Code, as amended by Ordinance 2023-37 on November 7, 2023. The section sets conditions that include these, in its own order.

  • No more than one ADU with each single-family detached home
  • Owner occupancy of either the ADU or the principal residence, apart from temporary bona fide absences, with ADUs permitted only in owner-occupied single-family homes
  • No external evidence of occupancy by more than one family, an ADU clearly incidental to the home's primary residential use, and no change to the building's character as a dwelling
  • The main structure's address for each unit and the option of directing renters' mail by apartment number
  • At least two off-street parking spaces for the home and one for the ADU; the ADU's required spaces hard surfaced with concrete or asphalt; garage and carport spaces counted as approved spaces; and the ADU's required stalls allowed in a front, rear, or side yard setback where they do not displace required landscaping
  • At least one and no more than two meters for each water and gas service, each in the property owner's name, and only one electric meter per building
  • Construction and remodeling for the ADU to the International Residential and Building Codes, as amended, in effect at the time of the work
  • On the ADU's lot, a landscaped yard under Section 18.76.020 and street trees under Chapter 12.20
  • No minimum size for any ADU and no maximum for one within a main building; for one within an accessory building, no more than 1,500 square feet and compliance with Section 18.68.060
  • A kitchen and a full bathroom separate from those of the main dwelling
  • A building permit application that adds two drawings to the standard submittal: a scaled site plan of the property lines and dimensions, the existing buildings or additions, their distances to the property lines, the parking stalls, and the utility meters; and scaled floor plans that label each room's use or proposed use
  • For a rented ADU, a city business license; possible annual inspections at license renewal for compliance with building, fire, and health codes, with no ADU approved without those inspections and the Building Safety Division's approval; and no business license without evidence of a Certificate of Occupancy
  • A Notice of Compliance Agreement recorded at the building permit application, at business licensure, or at both
  • No other type of accessory apartment, including any part of a home that has separate living quarters or a kitchen and is sectioned off from the other occupants, whatever their relationship, unless that part meets every requirement and standard of the section and an application has been made for it
  • An ADU never sold separately from the principal dwelling

Utah's ADU statutes apply in Heber City as well, as our ADU page explains.

Sources: Heber City Code, Section 18.68.611; Heber City, ADU Notice. The owner signs the city's ADU Notice and acknowledges it before a notary public. The notice describes an ADU outside the main dwelling as less than 1,500 square feet. Section 18.68.611 allows one in an accessory building of up to 1,500 square feet. The notice also states that every utility for the home and the ADU, electric and sewer included, is to be in the owner's name. Ordinance 2023-37 is the latest amendment to Section 18.68.611 in the online code. We confirm each condition with Heber City for your property during preconstruction.
