Accessory Dwelling Units
Accessory Apartment Rules in Sandy
Sandy's internal ADU guide, which cites Sandy City Code 21-11-1, lists conditions that include these.
- An administrative special use permit and an accessory apartment business license, issued together by the Community Development Department
- No accessory apartment in a home owned by an LLC, corporation, or partnership
- The owner living in the home as a primary residence while the apartment is rented
- One accessory apartment per home, inside the home itself, and never a detached unit or a mobile home
- A separate building permit for any construction, with the work held to the design standards of Section 21-11-1(b), among them entrance placement, exterior appearance matching the home, parking, and septic verification for a home not on sewer
- One additional single family in the apartment, with no subleasing
- A minimum rental term of 30 consecutive days
- The home's address and utility meters shared with the apartment, with no separate address, mailbox, or utility accounts
- Off-street parking available for the apartment occupants
- A permit that lasts until the home is sold, the owner moves out as the primary occupant, or the business license expires, and that does not transfer to a new owner
- The business license renewed each year, with the special use permit granted once

Sandy Remodeling and Permit Questions
Can I add a basement apartment in Sandy?
Yes. Building the apartment takes a Sandy building permit. Renting it takes an administrative special use permit and an accessory apartment business license. Both are issued only when the home is your primary residence and the deed lists you personally, or you as the trustor of a family trust holding at least half ownership, rather than an LLC, corporation, or partnership. Space kept for your own household and nonpaying guests is an extended living area, approved with the building permit alone.
How do building permits and inspections work in Sandy?
Sandy takes permit applications and building inspection requests through its Cityworks portal. The Building and Code Compliance Division's number is 801-568-7251.
